Mouseflow AI Terms

In the Mouseflow App, we use technology to provide you with the best possible experience, which includes access to AI-powered features integrated with trusted third-party providers (the “AI Features”). These AI Features are designed to assist you through automated analysis, insights, summaries, guidance, and support, helping you make effective use of the Mouseflow Service.

The AI Features may include, for example, an AI chatbot that helps you find information and receive support, or other AI-driven tools that provide analysis, recommendations, or summaries based on Customer Data.

The AI Features are available to Customers, who have entered into either the Mouseflow Terms of Use or an individual Subscription Agreement (hereinafter together referred to as the “Agreement“) and have accepted our Privacy Policy. Some AI Features may only be available under select Subscription Plans or as separate add-on purchases.

These additional AI Terms apply to your use of the AI Features. By using any AI Feature, you agree to these AI Terms in addition to the Agreement.

• “AI” means artificial intelligence.
• “AI Feature” means any AI-enabled functionality made available by Mouseflow, whether in the Mouseflow App, via an API, or otherwise.
• “AI Output” means output from any AI Feature based on input provided by the Customer or based on Customer Data collected by or transferred to Mouseflow.
• “Customer Data” has the meaning given in the Agreement.

AI Features use machine learning or similar technologies to assist with various functions within the Mouseflow App. These may include, for example:

• Providing insights, analytics, or summaries based on Customer Data.

• Offering automated guidance, recommendations, or responses to inquiries.

• Supporting user navigation and interaction through AI-powered chat or assistance.

AI Features are intended to enhance efficiency and user experience. They are designed for general informational or assistive purposes only and are not a substitute for professional judgment or human review.

While AI Features can provide valuable assistance, they have important limitations:

• AI Features may not understand complex, context-specific, or nuanced inputs.

• AI Features are not suitable for legal, compliance, or security-related determinations.

• AI Output may be inaccurate, incomplete, misleading, or irrelevant. You are solely responsible for evaluating the accuracy and suitability of any AI Output before relying on it.

• AI Output may not be unique, and other Customers may receive similar content from Mouseflow’s Services.

• Mouseflow continuously works to improve AI performance, but accuracy cannot be guaranteed.

For complex, sensitive, or unresolved inquiries, a human review or escalation process should be used before taking any action based on AI Output.

You may not use AI Features to:

• Input or upload prohibited data: including personal data, confidential information, or other content, that you are not lawfully permitted to share with Mouseflow or process using AI Features. This includes special categories of personal data, payment card data, authentication credentials, or any information subject to secrecy or regulatory protection (e.g. attorney–client privileged information, health data, or trade secrets).

• Generate or use outputs unlawfully: including to make or support decisions that produce legal or similarly significant effects on individuals (such as employment, credit, or eligibility decisions), or otherwise rely on such output without appropriate human review and validation.

• Misrepresent output as human-generated: including presenting or distributing AI-generated content as if created by a human or by Mouseflow without disclosure, or using AI output to mislead, impersonate, defame, or manipulate others.

• Train external AI models: using any data, input, or output obtained from AI Features to train, fine-tune, or improve any third-party AI systems or models.

• Circumvent controls or security: attempting to bypass, reverse engineer, or interfere with any AI-related functionalities, restrictions, or safety mechanisms implemented by Mouseflow.

AI Features do not provide legal, financial, or other professional advice. Any AI Output is for general information only and should not be relied upon as a substitute for advice from qualified professionals.

AI Features may produce AI Output that includes factual errors, inaccuracies, or incorrect conclusions. The Customer must review and verify AI Output before relying on it. AI Output may not be unique and other Customers may receive similar content.

The AI Features do not represent Mouseflow, and no commitments, representations, or warranties made by any AI Feature are binding on Mouseflow. Interactions with AI Features do not form part of, modify, or override any agreement between you and Mouseflow.

To the fullest extent permitted by law, Mouseflow disclaims all liability arising from your use of or reliance on any AI Feature or AI Output, and makes no warranties, express or implied, regarding the accuracy, completeness, uniqueness, or reliability of AI Output.

Any indemnity provided by Mouseflow under the Agreement, including relating to non-infringement of third-party rights, does not apply to AI Output.

When you use AI Features, Mouseflow may collect and process certain data to enable functionality and improve service quality. This may include:

• Inputs and AI Output: The text or other input you provide, and the corresponding AI Output generated.

• Customer Data: Customer Data relevant to the AI Feature for generating AI Output.

• Technical data: Device type, operating system, app version, and related metadata for performance and troubleshooting.

This data is processed for:

• Providing AI-based assistance and generating AI Output.

• Improving AI performance, reliability, and relevance.

• Troubleshooting and supporting the operation of AI Features.

• Analyzing aggregated usage patterns to enhance service quality.

• Developing and improving Mouseflow’s own algorithms and machine learning models.

Interactions with the AI Features and Customer Data may be processed by Mouseflow and its processors and subprocessors, including independent third-party AI service providers, as described in the Mouseflow Privacy Policy, the Mouseflow Data Processing Agreement and the applicable providers’ own terms and privacy policies.

Customer Data and your interactions with AI Features are never used to train any third-party AI models and are never shared across Mouseflow Customers or Accounts.

Mouseflow may modify, suspend, or discontinue the AI Features at any time without prior notice. Some AI Features may only be available under select Subscription Plans or as separate add-on purchases.
